Our growing elderly population is depending more on institutional care for various reasons – both social and medical. Nursing home liability is regulated by Federal and State laws, and nursing homes must follow legal standards of nursing care that regulate the quality of patient care. Unfortunately, often times these standards are breached, resulting in suffering and even death.
The top four complaints against nursing home care are: physical abuse, malnutrition, dehydration and verbal assault.
Common signs and symptoms of abuse:
Infections
Aspiration pneumonia
Over prescription of sedating medication (chemical restraint)
Falls
Fractures
Bruises
Bed/Pressure Sores
Malnutrition/Loss of Weight
Medication errors
Dehydration
Nursing homes may pose a risk to patients if they are understaffed or employ staff that are poorly trained, overworked or unethical. These and other conditions of care may result in neglect and abuse. The Federal Nursing Home Reform serves as a basis for standards in care giving. When these standards are not followed properly, there may be a basis for compensation. Nursing home residents deserve to live their lives with dignity and in comfort.
When nursing homes neglect to provide adequate care, medical professionals fail to notice and treat problems, or when residents suffer injuries from mistreatment and abuse, they need and deserve strong advocates — families and attorneys who care.
